Terms of Service

1. The Service

Cofoundr AI ("the Service") is a Meta Ads management platform for performance marketing agencies. It provides automated monitoring, wasted spend detection, guardrail rules, and reporting for Meta ad accounts you connect.

2. Eligibility

You must be at least 18 years old and have the authority to bind the entity on whose behalf you are using the Service. By connecting ad accounts, you represent that you have lawful access to manage those accounts.

3. Account and security

You are responsible for maintaining the security of your login credentials. You must notify us immediately at [email protected] if you suspect unauthorised access to your account.

4. Subscriptions and payment

• Plans are billed monthly or annually, in advance.
• The 14-day free trial does not require a credit card. At the end of the trial, you must subscribe to continue using the Service.
• Payments are processed by Razorpay. We do not store full card details.
• Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge for assistance.

4a. MCP Remote Server

The MCP Remote Server allows you to connect your ad account data to third-party AI tools via API tokens. By using this feature:

• You are responsible for securing your API tokens. Treat them like passwords.
• Write actions performed through MCP (pause, scale, create campaigns) are your responsibility. Cofoundr executes the action but does not verify intent beyond your token permissions.
• Write credits are non-refundable once consumed. Unused credits do not roll over between billing periods.
• We may suspend MCP access if we detect abuse, excessive error rates, or actions that violate Meta's advertising policies.
• MCP standalone plans (Starter, Pro, Business) are billed separately from platform plans. Cancellation takes effect at the end of the current billing period.

5. Acceptable use

You agree not to:

• Use the Service to violate any law or Meta's advertising policies.
• Attempt to access other users' data or accounts.
• Reverse-engineer, scrape, or resell the Service.
• Transmit malware or interfere with the operation of the platform.

6. Meta platform compliance

Your use of the Service is subject to Meta's Platform Terms and Developer Policies. We access your ad data through Meta's official APIs with permissions you explicitly grant. You may revoke access at any time through your Facebook Business Integrations settings.

7. AI-generated content

The Service uses AI to generate recommendations, reports, and creative suggestions. These are advisory only. You are solely responsible for reviewing and approving any changes made to your ad accounts, whether manual or through Autopilot rules you enable.

8. Data and privacy

Our handling of your data is governed by our Privacy Policy. You retain ownership of your advertising data. We use it solely to provide the Service.

9. Service availability

We aim for high availability but do not guarantee uninterrupted access. The Service depends on Meta's APIs, which may experience outages or rate limits outside our control. We are not liable for losses caused by third-party service disruptions.

10. Limitation of liability

To the maximum extent permitted by law, Cofoundr AI and its operators shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue from ad account performance.

11. Termination

You may cancel your subscription at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your access to the Service ends and we will delete your data in accordance with our Privacy Policy.

12. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Continued use after changes constitutes acceptance.

13. Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.
